Welcome to Ministry of Art! These Terms of Service ("Terms") govern your use of our online platform ("Platform") and the services provided therein. By accessing or using our Platform, you agree to be bound by these Terms. Please read them carefully.
1. User Responsibilities
1.1 Appropriate Use: You agree to use the Platform only for lawful purposes and in accordance with these Terms. You are responsible for all activities conducted under your account and must ensure your behavior complies with all applicable laws and regulations.
1.2 Supervision of Minors: If you are a parent or guardian, you are responsible for supervising the use of the Platform by your child. You must ensure your child’s compliance with these Terms, including their engagement with content and interactions on the Platform.
2. Limited Liability
2.1 Personal Liability: You are personally liable for any violation of a third party's rights by you or any user under your account.
2.2 Reimbursement: You agree to reimburse Ministry of Art for all damages resulting from any culpable non-observance of these Terms.
2.3 Release of Claims: You release Ministry of Art from all eligible claims that other users or third parties may file against Ministry of Art due to a violation of their rights by content posted by you.
2.4 Legal Defense Costs: You shall assume the costs of Ministry of Art's legal defense, including all court and legal fees, unless you are not responsible for the infringement.
2.5 No Warranty: Ministry of Art does not guarantee the accuracy, adequacy, correctness, validity, completeness, or suitability of information provided on the Platform.
2.6 Quality of Content: Ministry of Art does not warrant the quality of lectures, tutorials, or other educational content provided on the Platform.
2.7 Inappropriate Content: Ministry of Art shall make all efforts to remove any inappropriate content or conduct on the Platform, but disclaims any liability or responsibility in the event of such circumstances.
2.8 Child Safety: Ministry of Art will not be held responsible for any unethical or illegal acts performed by users, especially children, and it shall be the responsibility of parents or guardians to closely monitor their activities on the Platform.
2.9 Limitation of Liability: Ministry of Art shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Platform.
3. Privacy and Data Protection
3.1 Privacy Policy: Your use of the Platform is also governed by our Privacy Policy, which outlines how your personal information is collected, used, and protected. By using our Platform, you consent to the practices described in the Privacy Policy.
4. Content and Intellectual Property Rights
4.1 Ownership: All content, including but not limited to educational materials, videos, and images, available on the Platform are the property of Ministry of Art or its licensors and are protected by copyright, trademark, and other intellectual property laws.
4.2 User Content: Any content you create or upload remains your property, but by using our Platform, you grant Ministry of Art a non-exclusive, royalty-free, perpetual license to use, modify, and display such content for the purpose of operating and promoting the Platform.
5. Payments and Refunds
5.1 Payment Terms: All payments for services provided on the Platform must be made in accordance with the posted pricing and payment terms.
5.2 Refund Policy: Ministry of Art offers a no-questions-asked 100% refund for any unused sessions. We offer a free trial class to help you decide if our sessions are right for you. Once paid sessions begin, we cannot refund any completed classes.
Refunds for unused sessions will be adjusted based on the number of sessions completed at the applicable package rate. For example:
- If you booked 24 sessions but completed fewer, the refund will be calculated using the 8-session rate.
- If you booked 48 sessions and completed 24, the refund will be calculated using the 24-session rate.
Discounts or offers applied at the time of purchase will not be included in the refund calculation. Please note that any convenience fees paid during the transaction are non-refundable.
6. Termination
6.1 Company's Rights: Ministry of Art reserves the right to remove, restrict, cancel, or suspend access to the Platform if you breach any of these Terms.
6.2 User's Termination: You may terminate your agreement with Ministry of Art by ceasing to access the Platform.
7. Severability
7.1 Invalid Provisions: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the validity of the remaining provisions shall not be affected.
8. Assignment
8.1 Transfer of Rights: Rights and licenses granted by Ministry of Art cannot be transferred or assigned by you without Ministry of Art's discretion.
9. Waiver
9.1 Waiver: No waiver of any terms of this agreement shall be considered a further waiver, and Ministry of Art's failure to assert any right or provision does not constitute a waiver.
10. Governing Laws and Jurisdiction
10.1 Dispute Resolution: Any dispute shall be referred to an independent arbitrator in accordance with UAE laws.
10.2 Jurisdiction: These Terms shall be construed in accordance with the laws of the UAE, and courts in the UAE shall have exclusive jurisdiction.
10.3 Injunctive Relief: Ministry of Art shall have the right to seek injunctive relief to protect its intellectual property rights or confidential information.
11. Service Availability and Technical Issues
11.1 Service Availability: Ministry of Art does not guarantee uninterrupted access to the Platform. The Platform may be temporarily unavailable due to maintenance or technical issues.
12. Entire Agreement
12.1 Comprehensive Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement governing your use of Ministry of Art's Platform.
